Hello! A friend of mine recently got their license confiscated for a parking issue in SJDM, according sa enforcers ng SJDM, legal sila na magconfiscate ng license as per city ordinance daw. The thing is, yung ordinance na ginagamit nila, 2006 dated pa.
As per LTO, hindi na pwede magconfiscate ng license ang LGU officers, and City Law must not contradict National law.
Additionally, yung mga staff na kausap ng friend ko, tinatawanan lang siya at nginingitian habang nilalaban yung ticket at sinusubukan kunin lisensya niya.
Is there any legal basis that they can fight this issue or file a formal complaint?
EDIT:
They claimed the license this morning after paying the fine of 500PHP, as per their experience:
- Tinawanan at nginitian lang sila ng staff ng CTM
- They refused to print a complaint form and kept urging them to make a handwritten complaint
- They kept referring to the 2006 traffic ordinances despite my friends' protests.
I've told them to file a complaint to LTO SJDM and corresponding authorities.
