He'll be kept in this state until August 3 when Kentucky will no longer be able to hold a special election that would likely put Massey into the Senate until November ... did anybody mention Alito?

That special election is unconstitutional per Kentucky's Constitution. Beshear is responsible for selecting a replacement. They'll need to keep him plugged in to life support until the midterms.

Used to be so, but the Rs changed the law in 2024.

It's in the Kentucky Constitution, can't be changed with a law.

Perhaps, but at this point he question of that law's (un)constitutionality is irrelevant, as it will be answered in the short term by Senate President JD Vance, who will of course refuse to swear Beshear's appointee in, triggering a series of lawsuits, injunctions, and appeals that could (& would) burn far more clock than the 1, 3, or even 6 months they might need to stall in order to make the question moot.
