[NY] Employment Verification

I’m going through a Wells Fargo background check.

Everything cleared except one small real estate firm (3–4 people) that they couldn’t reach. The owner isn’t responding, and Wells Fargo HR is now reviewing it.

I provided my real estate license showing the company name and emails from my manager using my work email. I don’t have W-2/1099 or paystubs because I was paid by checks that I no longer have access to.

Has anyone experienced this? If the employer never responds, can Wells Fargo still clear the background check using alternative documentation, or could I fail solely because they couldn’t verify the employer?

[IN] Forced FMLA for outpatient surgery?

US- IN. I had outpatient gallbladder surgery and initially requested 5 sick days off. My post op paperwork says I can return to work "anytime." I decided to cancel 3 of my days requested since I feel fine. Our policy states that 4 or more consecutive sick days off requires FMLA, 3 days requires return-to-work notice from Dr, but nothing for 2 days (at this point I will have just taken 2 days off). HR is claiming I need to file for FMLA for ANY surgery. I have 240 sick hours accrued.

Can HR force me to file for FMLA? I'll be back to work by the time I reach back to HR about it and will have only taken 2 sick days.

Benefits [TX] Qualifying Life Event Question

My job recently announced they are doing away with our PPO plan effective January 1st. They’re still offering an HSA and an unsavory HMO plan but PPO is going away.

Our open enrollment is October 1st of this year and the PPO plan me and my kids are currently enrolled in will no longer be available come January 1st. My husband’s job has a great PPO plan that would meet our needs, but open enrollment at his job closed July 31st.

Would my job’s announcement that the PPO plan is going away count as a QLE for me and kids to join husbands insurance outside of their open enrollment period? Or would me deciding not to enroll in the HSA or HMO health plans at my job and subsequently losing coverage Jan 1 count as the QLE? I’m also expected to give birth sometime late December or early January. I’m thinking the birth of a new child will be enough for my husband to add the baby to his PPO, but does that QLE also open the door for our other children to join his insurance? I’m so mad at my job right now

[PA] Worried about PreEmployment Screening

PA location. I got an offer with McKesson. I have MS and my medical marijuana card that is active and live in PA. I smoke at night to sleep due to pain but I stopped for a month as I was interviewing. I had one night 2 weeks ago that was bad and I smoked 3 puffs but that was it. I took a test at home before my real test in 2 days and it was positive. I looked up their policy and it reads they will be adhere to state law as required but the language is gray but I think it's to say they won't accommodate use during work just because you have a card (which makes total sense) but the language is still scary. I looked up PA law and it reads they cannot discriminate. I know if I test positive in 2 days that it will go to a reviewer and I can show my card and active certification but I'm still scared that they can rescind the offer. I'm so mad at myself because I just don't want this to be a thing.

Am I ok?

[NY] Are employee engagement surveys actually anonymous?

For context I started a few months ago at a midsize regional company and I HATE it. I hate how we’re two people down on my team and we’re expected to do their jobs and my boss just keeps putting off hiring someone. I hate how things slip through the cracks and I get called out in front of everyone. I hate how the mistakes everyone else makes become my problem with my face written all over them. I hate how I’m given 14 hours of work and expected to fit it in 8 hours. I hate being here I hate the people and how aggressive everyone is. I just hate this job and it’s completely destroyed my spirit and personal life. And I’m not the only one who is just under complete stress all day but it’s considered normal.

And I want to say that in the employee engagement surve that’s coming out. But since my team is so small I’m very scared that my boss would somehow know it’s me. She claims we have to fill it out and it’s completely anonymous This is the kind of place where they’d blame my struggles of me retaliate and I just don’t want to deal with that

[IN] Changed my job without discussion.

I'm maybe just looking for advice, but also curious if this is like, a normal thing to have happen without any actual procedure.

I am a manager of team A and B, and there is another manager of C and D who recently left their position. My boss, who is above ABCD, asked if I wanted to change my job to AC and I said no.

Well last week, literally moments from entering the weekend, my boss told me that they decided they are going to change my position to AD and then post the other job as BC. I had a lot of concerns and of course immediately requested having a real meeting about it.

Today I find out the job was posted, and members of teams C and D have been told about the change. But not the members of A and B. Oh and I also have not been told what my job change is actually going to look like, how it is going to work, what my new duties will be, etc. (also might be worth knowing I've only been here for four months)

So like, does this just happen sometimes? Is this forced change enough leverage to ask for a pay adjustment? Is there even really anything here for me to be upset by or is it just one of those corporate "yeah it sucks but they own you so they can do what they want" situations?

In this position, you must see the writing on the wall that your job is about to be toast. My question — Is there an incentive for HR to stay and lay off themself? (Whether it be monetary or a good resume builder to say you laid off yourself or both?)

[NY] HireRight employer name mismatch

One company on my resume and job application portal was listed as my employer (ABC), but ABC was actually the client/middle company. My actual employer was XYZ, and XYZ can fully verify my employment.

HireRight has prefilled ABC from my resume. I want to change it to XYZ because that is my actual employer. I understand I should provide the correct information, but what happens because my resume/application previously showed ABC as my full-time employer?

Will HireRight simply flag it as a discrepancy, or could the new employer consider this a serious issue?

Recruitment & Talent Acquisition [CAN] Recently started a job, just got another offer.

As the title says, I started a job in July and it’s been very mediocre compared to what was sold to me. The VP is a total B and everyone in the team tells me this consistently. People in the business also have mentioned their huge dislike of my VP. That among other things has really put a bad taste in my mouth for this place and the work is just not worth what I hoped it would be at all.

I was reached out to last week about a job, fast forward to today and they have verbally offered to me. It’s a 13% increase but overall a way better company, total comp, benefits, and more aligned in the direction my career is headed. It’ll be a bit of a learning curve but is by far more aligned to my skill set. The leader also “sounds” wonderful and supportive and they are fully on board to help me get up to speed.

Also- I was head hunted through a recruitment firm for this current role I am in, so that adds a layer to this dilemma too.

How terrible is it to tell them just 6 weeks after starting that I’m accepting another position?

Leadership [AZ] Is this workplace harrassment/can I report this?

My current boss put in a good word to get me hired since I’ve worked with him before. But that was about 2 years ago and he was really nice then, now he’s just all over the place. He’s made some really uncomfortable comments and when I explain how I feel he gets defensive, brushes me off, or says nobody asked me and to get back to work.

Here are some of the incidents that have happened. I need to know if I can report this to our GM because I just feel a bit anxious to be alone in an office with him. Today it bit the head since he yelled and swore at me due to his own frustration but he does not do that to anyone else.

Continued swearing for a bit about how my report is stupid and he hates that it’s online.

I just sent it again even thought I literally just sent the same thing twice and he’s like “This is fine, don’t do anything else”

Can employers see details of a case on background check [VA]

So I was arrested for assault. Clean background up until then. The charges were ultimately dropped by the prosecution, no conviction or plea deal, but to be completely honest they had enough to convict me, the individual just refused to cooperate. I'm trying to change jobs but worried about background check showing details of the case. I understand that the charge and non-conviction will show up, but will police incident reports, testimony, my/victim statements also show? And what would be the best way to respond if asked about in an interview about the charge? Thanks for help.

Workplace Issues [NO] How inappropriate was this comment?

I (F40) work the morning shift alone, so I'm usually the person to let in the delivery guy and sign for the deliveries every day when nobody else is around. Our interactions are brief but polite, and sometimes includes smalltalk touching on what we did over the weekend etc. He's of retirement age, old enough to be my grandfather.

There's been an issue with key fobs not working, so today he asked for my number in order to call me next time his doesn't work. I didn't think too much of it as there genuinely is an access problem in the building. But as I'm giving my number, he immediately jokes that "Don't worry, I won't be sending you dickpics"... and my heart sank.

Is this just a boomer who's proud of the hip new lingo he picked up? Or is it bad? I think it wouldn't feel as gross if anyone else had been around to witness it.

I'm in a bit of a pickle and could use some advice. I've been at my current job 4.5 years and am desperate for a new job. I have been interviewing with a direct competitor and ita going super well but when they asked if I had signed a non-compete, I panicked and said "No" when I had 😭

I know that was incredibly stupid but I was so scared they end the convo there. I'm currently scheduled for round 4/5 interviews so nothing on the table yet but wondering where do I go from here?

Should I beg my employer to waive the non-compete or come cleanish to HR and say I revisited my paperwork and found a clause that might be an issue?

Any advice would be so appreciated!

Workplace Issues [TN] Sexual Harassment

Am I being sexually harassed?

I’ve worked at my job for 3 years now and I feel as if I’m being sexual harassed. First off I am a straight male and it’s happening by a DL gay man. I obviously won’t put his real name on here so I’ll refer to him as “Tim”

Tim started off being really friendly when I first started the job and would always be there if I needed help with anything.

So friendly that I started to feel something is off about him.

Tim portrays to be one thing but at times would do things a lot of straight men don’t do. He would leave me a note by where I work and say “ whats up :)”, he started asking me to walk out together once our shift is over, he would wait in the parking lot for me to get there to walk in with me.

Tim never texted me anything inappropriate but would always text me after work and would call me on the weekends. It got to the point where I had to
tell him to stop. I blocked his number because it was too frequent.

To make a long story short, Tim would always look at me up and down in an odd way. He always asked me to hang outside of work even once I told him no multiple times. He started asking me “did you ever fantasize” and I responded with “no what are you talking about” and he just kept saying “read between the lines.” He one time mouthed the words “will you be my boyfriend” and at the time I thought I was going crazy because I’m thinking to myself “did he really just say that or am I tripping out??” I later found out that’s exactly what he said.

One guy came and asked me one day “some of us were joking around and the question asked was : if you were gay, would you be a top or bottom?”

I responded with “none of that.”

I later asked Tim was he apart of this so called conversation and when I asked him, he got mad at me. Tim started saying “what are you talking about, I don’t even know what a top or bottom is , I’ve never heard of that, why are you asking me this.” I felt bad because I thought maybe I was wrong and he really didn’t have anything to do with it…

Come to later find out, it was Tim who told the guy to come and ask me that question all along to see how I would respond.

I don’t have proof but I even saw him taking pictures of me while working. The first time I thought I saw it I didnt say anything because in my mind I could totally be wrong. The 2nd time I was sitting down in the break area and I saw him try to take one of me and I asked him what was he doing. He responded with “I’m just playing I’m on Snapchat” (he’s 40 years old btw). I told him to not do that and he just kept saying “I’m just playing.” The 3rd time, someone comes up to me and tells me “don’t tell anyone but I’m pretty sure I saw him taking pictures of you.” At this point I went to HR.

I’ve even had someone come up to me and say he over heard Tim talking about me saying “it’s like I’m obsessed with him”

I eventually had to pull Tim aside and ask him about his sexuality. I asked him was he gay or bisexual. He told me no he’s not (which now I know is a lie) , then he proceeded to question me about mine. I have not given him any reason to believe I was gay or anything. I’ve only been kind to him and that is one of my biggest regrets.

One day, a guy I worked with came up to me and asked me “is everything okay? I noticed you and Tim don’t really talk anymore.” I told him “yeah I just try to keep my distance from him now.” The next thing he asked me was “it something sexual?”

I told him “yes , how’d you know”

He then proceeded to tell me what everything Tim was trying to do. He said it’s like a game for Tim to see if he can “flip a straight man”

HR did absolutely nothing. No one wanted to come forward and state what they saw or have heard him say about me. Because I have no proof, they’re treating it like it never happened. He’s given me unwanted compliments about my appearance, made a comment about he likes the way my lips look and so on.

I’m sorry for the long text. I didn’t type out everything I really want to say I just don’t know what to do anymore. I’ve become so filled with anger towards the situation and some days I don’t even want to go into work.

Leaves Maternity/bonding [CA]

CA employee here. I am on bonding and had been looking for a job for almost 2 years. I got paid for the state leave already for medical we had complicated pregnancy. So now Sedgwick is paying 12 weeks in full.
New job starts during that time.
Do you all know if:
1 I will need to pay back if I resign during the leave or at the end?
2 am i required to return to work for x amount of time to not need to pay back?
3 does this mean I can just leave them and drop the ball and not return and not need to pay back anything?

Old friends/exemployeessaid no since it’s part of my benefits of being an employee and still being one. Others have not returned after leave and other employees in other companies too.

And I haven’t disclosed or said anything to anyone

Policy & Procedures [CAN-BC] [CAN-AB] [CAN-US] “Friend” violated his HR guidelines what does it mean for me?

So I (44F) have been chatting with my long term friend (50M) who I met at work. We are both in different jobs and provinces ten years later but we got back in contact through TikTok during Covid. His wife is very jealous (understandably he is a total flirt) so we chat on his work phone.

Recently, his company was bought out by an American conglomerate, and he was informed that his cell phone use was being monitored. He told me this and so we chose to use more PG wording for our conversations, even though it would only pass a keyword test and not actual human observation. We spent a lot of time talking about mutual kink in a way that might be considered cheating, depending on the confines of someone’s relationship (not mine but that’s a different subreddit I assume).

He sent an unsolicited spicy pic and got called into HR… I think because either he knew it was being monitored and sent the pic anyways or that you can tell that he wasn’t in his work vehicle because of the background in the picture… I also assume the picture itself.

He told me that he was suspended without pay for a week and had to do mandatory training… And would likely not be able to contact me anymore as his wife monitors all of his social media and apps, etc. and likely his work phone wouldn’t be an option going forward though they didn’t block my number.

Selfishly my question is, how does this affect me?

We have worked in similar industries, would this come up if I tried to get a job at one of the subsidiaries?

Would they tell his wife any of the details of what happened?

Would they have audio recordings as well? Do I have any privacy rights when it comes to those calls?

Do they store any of the information about me especially things sent before they bought the company out?

Is it worth it to contact the HR department of his office or would that just cause more problems?

He is still off work so I can’t ask him but I’m freaking out a little… help me Reddit!!

[PH] HR/Admin professional handling a family-owned business responsibility without authority

HR/Admin professionals, I’d like to hear your thoughts.

I have previous experience in HR, Admin and Accounting sa previous companies ko. I had clear responsibilities, authority and processes. When my partner, a freelance engineer, decided to build his own company, I helped build it from zero even the business name was my idea. We started with no employees, and I handled the permits, Admin, HR, Accounting, payroll, funds/PCF, BIR related expense records and other documentation because these are areas I have experience in. I’m a housewife and partner of the owner, doing all of this without salary.

The problem started when we began hiring workers. I’m given the responsibilities but not the authority. Our timekeeper is my partner’s sibling, and we’ve had recurring issues with incomplete/inaccurate liquidation, shortages, and PCF being used for personal purposes. There are also CA's released without proper coordination despite basic policies already being set. When I raise these concerns, my partner tends to tolerate them and dismisses my concerns. He even tells me I have “anger issues” because he thinks these concerns are “not a big deal.”

Same issue with CA requests. A worker requests from me first, I coordinate with my partner, and he tells me it’s disapproved, so I inform the worker. Then the worker goes directly to my partner, suddenly gets approved, and comes back to me expecting immediate release, making me look like I’m the one delaying them while my partner looks like the accommodating one. This has happened repeatedly with different workers.

At the same time, when I need basic records like complete time-in logbooks for payroll, my requests are ignored. But when workers need something, they expect me to be available 24/7, calling early in the morning while I’m still asleep and expecting their requests to be processed immediately even at night. I’m not their assistant.

I’m carrying Admin, HR, Accounting, payroll, permits, funds/PCF and BIR-related records without salary, yet I’m expected to accommodate everyone while my authority and basic processes are not respected.

Has anyone experienced this in a family-owned business where the owner is your partner?

How do you establish professional boundaries and authority when you’re given the responsibility but not the authority or support to enforce it?

[TN] pregnancy discrimination?

I have worked for a company for about 10 months. About four months in, I found out I was pregnant with my second child. I was told this would NOT affect my job when I brought it up to the owner.
Around the time I was 6.5 months pregnant I tripped at work on some carpet that had a hump. I never fell, just a small trip over my sandal and I was fine. All of us have tripped on it at the office but it’s never been a big issue before. A few hours following this, a co-worker who’s above me let me know just in passing that I need to work from home since me tripping scared the boss and I need to watch my hours because the company is low on money.
Later that day I ask the owner about all this and he confirms he wants me working from home due to this carpet incident. I told him I cannot do 100% of my duties from home but I can work from home more often (I am part time and normally worked from home 1 day a week) but I would have to come in occasionally to use my desktop and have the proper mailing items/paperwork and to scan papers into our systems. His suggestion was to put me alone in a conference room to work that did not have my desktop, scanner or the needed materials in there. At this point I could see where things were going and I straight up asked him if I was going to have a job after my son is born and he said “I can try” but that they were just so low on hours to give me.
No one else who had tripped over the carpet ever got asked to work from home and no one else got reduced hours.
A few days after all of this I tried getting ahold of my employer (the owner) and it took him a while to get back to me as I was tying to figure out what I’m supposed to be doing now with my job and how much I am allowed to work at this point. He had let me know that one of the employees told him I had quit. I told said employee I was going to need another job along side this one to supplement lost income. Never that I was leaving. Once I learned this I told him that was not the case but he let me know that he just didn’t have the hours for me. I have confirmed with one employee that no one else’s hours were affected.
I also have asked for my separation notice since that day. In the state of Tennessee you have 24 hours to send your employee their separation letter. While there’s nothing I can do legally about that, I have asked them for it multiple tines despite it now being 3.5 days since being let go.

What can I do? Does this fall under the Pregnant Worker’s Fairness Act?

[WV] disability disclosure pressure by preceptor.

Hi! So I’m gonna try to keep it brief but I am a graduate student in my first clinical rotation with autism and adhd, and a few other diagnoses(but this doesn’t need to be longer lmao). my clinical preceptor and I don’t really get along very well due to, what I’ve been told by multiple people are, his unrealistic expectations and entitlements. He was brand new to the job before I got assigned to him and I am his first student. I was going above and beyond(according to multiple people) by even making a weekly schedule for him to approve of so that we both could see the hours I would be getting, and the days I would potentially have to miss so our communication was as clear as possible. The other day I finally got to the site after being in class all day and he suddenly is going off on me with no warning sign or communication of us having a “talk.” This ultimately gets me flustered and to the point where I’m crying cause it was fully unexpected, as he was acting completely normal with me and I was already quite drained from the hours worth of lectures I just sat through. He sort of just makes a lot of rude comments and remarks the whole conversation. And ultimately complains “it felt like I didn’t want to be there,” this makes me immediately think maybe I was not showing up with my mind fully present but after asking him if that’s what he meant he explained it was more so because I asked to be off on a day where I had classes, mind you on class days I am there for 1.5-2 hrs at max due to the schedule, and coming on days where I didn’t have classes were more beneficial to get my required hours and open the door to more things I can do/learn. Ultimately though the priority is truly getting the required hours of my program and degree, and I was achieving that. So his complaints were ultimately confusing and truthfully sort of invalid. During this conversation towards the end when I’m very clearly distraught and crying(in a very public space, 3 diff people walked in during our convo) he hits me with “what even are your disabilities? I need to know them so.” This caught me off guard and pressured to say them or our relationship would continue to crumble and I have to spend 10 weeks with him. In the past I did disclose I had disabilities but I left it at that as I didn’t feel comfortable or okay with naming them, which I also expressed after he ask that and he still pushed. From my understanding and after talking with my psychiatrist he should not have asked and could be in trouble for such? I essentially am trying to come here to see if I can get some clarity on the situation and possibly some sources to site if I must bring it to the attention of my program directors! As I’m not quite sure where to look/start and get a little overwhelmed when I go looking for sources on my own. So calling all very smart people for some help!
