TD/Shipping Question Canada Customs Requesting Invoice
Canada customs has requested an invoice/proof of payment/declaration of a rep watch. The seller had declared it as a bracelet. Any advice from Canadians on how to move forward?

Do not respond or claim it's yours. Let them send it back. Contact your TD for a replacement.

Right now, they can't prove that you ordered it. Someone could be dropshipping you something you know nothing about. Don't admit to anything and contact TD. Even in the worst-case scenario, if you lose a watch, it's cheaper than getting charged with importing counterfeit goods.

According to previous posts here's it's actually legal to import into Canada for personal use. Some guy did it previously and just had to pay duties after showing receipt

source? it's legal to import for personal use in your own luggage as that's an exemption if you carry it on your person yourself. shipping via mail does not fall under this and is not legal and CBSA can definitely seize and destroy and you are better off not taking the risk of acknowledging the seizure.
the relevant policy is outlined in this Memorandum by CBSA specifying guidelines of dealing with counterfeit goods Memorandum D19-4-3 subsection 6 This prohibition does not apply to copies that are imported or exported by an individual in their possession or baggage if the circumstances, including the number of copies, indicate that the copies are intended only for their personal use.

Buddy it states under section 25-28 unless Rolex decided to sue OP, they must release the package. I highly doubt Rolex is going to sue OP.
Plus if you look at the letter it appears to be held for invoice so it's probably something else all together

I did see that. My concern is what if they inspect it after my invoice is sent in.

Then you ordered from a refurbishing company that uses genuine dials and sources their own cases and movements. Customs is more concerned with drugs, weapons, and big counterfeit import. Prosecuting solo purchases isn’t worth the time and money.

here's the reality of the situation:
the description (and thus value) is mis-declared. so if you reply, best case is you're going to be paying tax on the item, they've opened it and they see what it is, so you're either going show them a paper trail of purchasing counterfeit goods or they're going to charge you tax on the genuine article. truthfully, i'm not entirely sure what would happen if you just straight up said "it's a fake, here's the bill", they may just charge you whatever the adjusted amount should be and clear it for delivery, i don't know, but...
as others have stated, purchasing counterfeit goods for personal use isn't "illegal" in canada, only commercial import and distribution is. however, the cbsa has a duty to report trademark/ip infringements to the property owner. the brand has 3 days to respond and the absolute worst case scenario is they demand seizure of the item.
since you don't know what their next steps are going to be, check to see if you had insurance included in your purchase and probably go that route instead of engaging this as the cbsa can look at this as a moral issue (under valuing goods to save on taxes) which can create scrutiny down the line.
your best bet is to ignore the letter and hope you had insurance.

This happened to me , they don’t care about the watch in Canada they care about the taxes . I showed them what’s app msgs with the amount I paid and then the payment I made on wise and it matched and they made me a new bill for taxes and then gave me the watch . In a building near the airport. They do not care that you bought a fake watch from the internet and they do not care about Rolex . Good luck

Contact your TD on how to proceed. They SHOULD offer refund or reship. I wouldn’t respond to fuck all in regards to customs agent.
