Is this a serious question? 

Getting down on the ground and sticking your nose near somebody's ass is no different than putting your face next to their cleavage or their dick depending on their gender. I mean that's definitely sexual harassment

I mean that's a massive invasion of private space and would be pretty hard to contest that it's not sexual harassment. I mean the guys literally stalking people. 

I took the 5 seconds to look up what the exactly have been charging him with apparently he's been arrested for this multiple times. 

under California law, both lewd conduct (Penal Code 647(a)) and loitering with intent to commit a crime are legally classified as misdemeanors

I think it would be pretty hard to deny that doing this to a stranger could easily be considered lewd conduct. And it's impossible to deny that he wasn't loitering with the intention of committing said lewd conduct.
