NFA ruling
So I know it’s way too soon for anyone to know anything but what does this ruling mean for the state of Wisconsin? I know they didn’t join the list of states that wanted to be plaintiffs, but if you’re a member of GOA or buy from PSA or Silencer Shop can we just get it shipped to our FFL of choice and not have to fill out a Form 4? I know Wisconsin has their statutes that state that SBR’s, SBS’s, and Suppressors are legal as long as they’re registered with the ATF but if that registration is null if you buy from those organizations or are a member of them does that mean we just fill out a 4473 and be on our way? TIA

We still have to do form 4 for suppressor, form 1 for sbr/sbs, along with the 4473. Good thing is that with so many states no longer having to deal with that, approval times should drop dramatically. That being said, call your senator.

Agree on form 4, disagree on form 1. Making is legal if you're legal to own it under federal law.

Thank you for reaching out to Grieve Law about the recent changes to how suppressors, short barreled rifles, short barreled shotguns, and AOWs are being treated under federal law. We have heard from an enormous number of people both nationally and from within Wisconsin on this exact topic, so please forgive the templated response. We want to make sure everyone gets accurate information as quickly as possible rather than waiting days for a personal reply.
Here is a quick summary of where things stand as of now:
On August 5, 2026, a federal court ruled in Silencer Shop Foundation v. ATF that the NFA's registration and approval requirements for suppressors, short barreled rifles, short barreled shotguns, and AOWs are unconstitutional now that Congress reduced the related tax to zero. The court's temporary stay has since lapsed, and there will be no appeal from the federal government. This means the permanent order is now in place and our world has changed.
What we want to be very clear about is that this situation is still developing and the scope of who is currently covered is not settled for everyone. The ruling explicitly protects members of the plaintiff organizations involved in the case and customers of a handful of specific companies named in the lawsuit. Whether and how this extends more broadly is still working itself out, and it could change literally by the day.
We have broken the update nationally that the ATF itself is advising dealers that they have no guidance or comment to give about the situation at this time. Effectively, this means that they are not giving anyone the green light. That is an important piece of the picture and shows just how unsettled this still is.

Love that you posted specially for Wisconsin. I am definitely going to call my local reps and even invite the dems to the range for education. Anytime you want to go too reach out, I've got access to a pretty incredible place to shoot long range too. FFL 07 holding off on the 02 for now... I wish we could get more support for domestic manufacturers on not having to register for ITAR too. Keeps my dreams of growing as a new startup squashed.

That's how it reads but we should all put pressure on our senators and representatives to change the written law especially if the NFA crumbles completely

I think the problem will be silencers, because the law is worded differently to that of SBR/SBS:
(c) Any person who has complied with the licensing and registration requirements under 26 USC 5801 to 5872.
It may be that this is something that can be fixed easily with a statement saying that anyone in the plaintiff group is deemed to be compliant with 26 USC 5801 to 5872, but who knows.

It is a paradox due to the WI statue stating as long as you are federally compliant you are also state compliant but with some people I talked with at the Legislature Office they recommended to talk with an attorney who is in the know, but they don’t know of anyone who knows. Additionally I had a handful of cans come in today from silencer shop and they submitted everything without my input. What I would recommend is take it slow. Today is the first day of this significant change, reach out to our law makers or whoever and start the discussion/pressure.

Problem is people are only talking about the Form 4 for WI, not Form 1… we need guidance on that part….
