Possible Fraternization Outcomes
I have a soldier who is a fairly new SGT but was a SPC when she was involved with her company XO. The Soldier as well as the LT are married. The soldiers spouse caught wind of the relationship and gathered screenshots and messages of the 2 talking sexual as well as meeting up in the Officer barracks. The messages indicate that sex was had but it’s not definitive enough to be hit with Adultery. I know it’s all CDRs discretion but what are some of the outcomes you’ve seen with cases like this?

I know it sucks- but usually just Article 15s / GOMORs (if you’re lucky) and that’s all. From my experience:
Investigation gets under way- about 20% of the evidence you had starts falling off for various reasons: people’s stories and what they heard change rapidly under sworn statements, spouses cool down and/or realize there’s a financial punishment to them too, and people start blocking and tackling for one side or the other that they believe are “right” (she’s a good Soldier, he’s a young officer who made a mistake etc.).
In the cases I’ve seen (only about 4 tbh) every single time both of the accused broke ranks and started accusing the other of being more of the perpetrator. It’s honestly the smartest play, because it leads to people taking sides.
Typically Officer misconduct is required to be presented to a higher level by policy (often 1 Star). So, depending how much of a weenie the CO is that could mean either A) no punishment at all or B) an overly thorough investigation where every piece of evidence gets sharp shot until you’ve lost sight of actually punishing someone.

I can see it going both ways. Possibly no punishment but it’s a bad look on the unit if the company CDR does nothing about it. Because it’s a LT involved I would assume it goes to BN. If it reaches the BN CDRs desk I can imagine harsh punishment coming down

Both of them are toast. CG gives the LT a GOMOR and refers them to an elimination board. The NCO will get an article 15 and probably reduced.

What are officer barracks?
If you're asking, you don't get to decide if it's "not definitive enough" to be adultery, because it doesn't take much. Article 134 covers almost ANYTHING for enlisted and Artlce 133 is similar for officers. So yea, they can get into career ending trouble.

It can be hard to prove because there's three separate things they need to establish, but from what you're saying, they have quite a bit there.
1st: Need to show sexual conduct happened. The text messages sound like they're enough to investigate this and likely will be enough to meet this.
2nd: Need to show they were aware the other was married. Both were married to someone else so this would be hard to dispute.
3rd: Needs to show the conduct hurts good order and discipline. Since it's an XO and NCO doing this, you almost certainly have this.
Like the only thing that likely would make this more concrete is if there's actual video proof. But there's enough that investigating is almost certainly and almost certainly they both are fucked.

There is no mutual consent in this scenario, especially when they're both married. There is certainly a power dynamic at play, it doesn't have to be quid pro quo. Power dynamics are an aside anyway. Officers are held to a higher standard, this is a catastrophic moral failing, or at least it would be under other Administrations and proper leadership.

It’s implied in the messages but adultery is really hard to prove. Hence why I said it’s there but ultimately it can be denied because you can’t prove sex actually took place.

Look, if the burden of proof is "did you personally see the penis enter the vagina?", then adultery would be unprovable. More likely, the UCMJ authority will look at the evidence and either say "yep, meets the evidentiary burden" or say not guilty on adultery but max punishment on fraternization.

The maximum punishment for adultery—officially called extramarital sexual conduct under Article 134 of the UCMJ Law—includes a dishonorable discharge, forfeiture of all pay and allowances, and confinement for up to one year.
Convictions under a general court-martial carry severe maximum penalties, including a dishonorable or bad-conduct discharge, forfeiture of all pay and allowances, up to 12 months of confinement, and reduction in rank.
To secure a conviction under Article 134, the prosecution must establish that the accused engaged in sexual contact with someone other than their spouse, that one of the parties was married to another person, and that the conduct prejudiced good order and discipline or discredited the armed forces

Article 15’s and GOMOR’s most commonly. Conduct unbecoming or conduct prejudicial to good order and discipline are the catch all’s with a low bar for proof. For adultery you need to prove knowledge of the marriage. For fraternization it’s more broad re: inappropriateness of relationship.

If investigation finds that the accusations are likely beyond a reasonable doubt the Soldier will likely receive a FG Art 15 and continue their service.
Officer punishments are typically held at the GO level and it’s extremely difficult to “kick” an officer out as O separations are a completely different regulation and follow completely different laws.
That said, the officer will likely receive a GOMOR and either lose their promotable status (if promotable) or not be selected for O-3. They’ll likely be allowed to submit an UQR or face an elimination for failure to promote if they don’t submit an UQR.

Should GOMOR the LT and kick them out.
Article 15 the SGT and move on with life. You can argue that they were a victim.
Edit 1 I thought about it some more and if the SGT admits that the XO was sleeping with them I would just reassign the SGT elsewhere. Huge power imbalance between an XO and SPC.
The Army doesn't need Officers in leadership positions that sleep with junior soldiers

If the soldier is denying everything and it looks like a potentially consensual situation then i woildnt be surprised if its just swept under the rug maybe a counseling

All you can do is let the process play out. No point in speculating. Provide any info to your leadership and let them figure it out.
And honestly good on the spouse for reporting it. If I was the spouse in question I would divorce the Soldier and do everything in my power to burn that XO. Id message his wife, blast them on social media, message his leadership, etc.

I feel bad for the spouses who got cheated on but shit happens every day in the real world. I think the real crime here is officers sleeping with their subordinate. We arent talking some seasoned SSG. It was a junior soldier at the time.

Once had an adultery case, which involved a train of dudes on a girl after a mission was done. The Staff Duty NCO and O heard a lot of noise coming from that room, so they used the key. Caught this happening with their own eyes. Was a funny and interesting case. The girl actually caught the most charges out of it.

We don't want the military to be the vanguard of a (re)new(ed) puritan morality, enforced by the government. Largely because the military leads the way on social change.
Getting rid of higher ranks who dip into lower ranks makes sense. But dusting off a statute criminalizing normal sexual foibles.
We keep it on the books as a sort of moral Article 134; A catchall for situations that rend the fabric of military (not family) culture like an RDC jodying it up while his unit is in the sandbox.

You can’t even have a ton of debt without losing clearance but sleeping around while married which is way better blackmail material is a okay? It’s much deeper than morality it’s also integrity. Dishonorable discharge? Adultery isnt really court martialed and the NCO woud be considered the junior and would be unlikely to face severe punishment, definitely not a court martial. As for Officers its called dismissal and that comes from a General Court Martial. The Army doesnt see taking a court martial panel, govt appointed lawyers, a judge, and witnesses out of work for two weeks and giving any witnesses who PCSed tdy pay, to try people for having sex. Every base would be saddled with an unmanageable amount of petty court martials. Then after conviction, the panel may recommend jail, which is more expensive. Additionally there is a backlog on a lot of dockets to try rapists, child sex offenders, arsonists, and murderers, so those would get slowed down as well.
So basically, not only is this idea a huge waste of money and time, it slows down really important cases. Just kick them out the cheap and easy way with a gomor and move out. People having consensual sex when they are married is scummy, illegal, and really irritating to everyone who has to deal with it but it isnt general court martial level, nor is it prison-worthy, unless it was coerced.

You don’t read the court martial files much, do you? That’s a pretty big assumption. A few adultery cases were tried this year and they all resulted in convictions. Army doesn’t give a shit about the cost. Hell….I got flown across the world to attended a court martial as a witness and wasn’t even used. The cost of my TDY was crazy and l wasn’t the only one that was there.

Ive been in court martial panels over the last 20+ years and every adultery case i have seen had aggravating circumstances or multiple other charges. I have literally never seen an article 134, adultery court martial for that alone. Im not saying it hasnt happened but even when i pushed it as a commander back in 2012-2014, i was repeatedly told the government doesnt have an interest in pursuing adultery at a GCM without other charges. I have sat on court martial panels, though not in over a decade. I have also testified at gcms and just spectated. Its definitely not common to have just an adultery case and most government counsels and senior commanders will push back on it and/or just kill it.

Possibly. I’ve seen a similar situation between a male SGT and a female officer where text messages were brought forward. Neither made a statement but it was claimed the third party that brought the messages created them with AI. Whole thing was dropped.

Demotion with company grade for junior enlisted and field grade with letter of reprimand for senior enlisted which resulted in rcp. Same outcome every time it happened back in the early 2010’s where I was located (both ait and regular duty stations).

Ahhhh… I’m so fortunate I never had to go to Korea. The few O’s I knew that went lived in apartments.
That said, in your scenario, it’s wild he’d invite her to that location due to the, I assume, difficultly getting her in and out unseen.
So likely case is early exit from the Army for both.

CGs withhold all officer disciplinary action. At best, the LT gets a local LOR and referred OER. Most likely, GOMOR and elimination action (zero defect Army). Assuming not prior service, they don’t have enough TIS to be afforded due process request a board of inquiry and fight it. At worst, UCMJ for adultery.
As for the SGT? FG Article 15, probably. They’ll recover.

So I did a 15-6 that was a follow-on/result of another 15-6 that investigated a case of an LT and a junior enlisted having sex, so part of the documents that got turned over to me were the results of that investigation.
The LT got a GOMAR and moved to a different unit.

Dishonorable discharge is worse than a felony. There are ways you can talk yourself out of a felony and make yourself look good, but there's no way you're gonna talk yourself out of a dishonorable discharge. First of all, there are too many retired veterans that know different. A felony is in some ways judged by your character. But a dishonorable discharge—it's all about your character and honor. And most people besides McDonald's hamburger are gonna have a second opinion about hiring you.

For the officer, he's done being promoted. I've known a couple of officers who've done this and if it's kept quiet, nothing happens. But this has already been reported. 1LT is finishing his time in the Army as a 1LT and needs to find a new job. They might allow him to finish out his term, or his ADSO might expire while this is shaking out, but his CPT bars are gone. SGT could be the same, but realistically she's probably able to get past it if she wants to stay in.

This can go either way depending upon who is on whose golden boy list or shit list.
I've seen people slammed for less, and I've seen much worse get swept under the rug.
But just taken at face value, the XO really fucked up screwing around with a junior enlisted, especially in the same unit/chain of command. The SPC knew better, but she was on the lower end of the power structure, so I would assume her punishment to be much less, if anything. What actually happens will come down to who is on which list reference above.
Here's my prediction: the XO will get slammed, the SPC we'll get a summarized and do some extra duty.

I heard of an instance long ago where a male MSG got involved with a newly commissioned 2LT and both got the boot. Both were married. MSG might have been a forced retirement but the 2LT definitely got booted out.

In the two cases that I witnessed during my career, the offending officer disappeared. My station was Coleman Barracks, Germany. I found them while I was installation duty officer and had to count prisoners at the U.S. Army Europe Detention Facility. This does not bode well for the lieutenant.

One of my LT buddies fell victim to one of the 9 females in the BN at the time. My semi handsome friend took his GOMAR like a man. He's a civilian now. I think the SPC got an article 15, high fives all around in the barracks, and most likely a rotten case of herpes. Good luck..

(Retired senior NCO). It’s gonna come down to who they assign as the 15-6 investigating office and his/her recommendation to the CDR or the CDR’s personal feelings about it. I witnessed 3 in my career of people I personally knew…nothing happened to them. They didn’t have the O & E factor…they were all enlisted.

Sir, at some point the dust is going to settle. After your chapter, and being sidelined with a significant amount of what will basically be unpayable debt due to all the money the army spent to give you an education which you now need to pay back; you will have a moment of clarity to process all of this. Remember these words:
"If you'd like to save 10% on your purchase today, could I interest you in applying for a Lowe's credit card?"
