So I recently just moved here to the Austin area (in May), immediately started applying for jobs and finally found one in June- I worked for a certain unnamed, "Appliance Family" based in North Austin.
I was employed as a 1099 contractor (mostly for the owner to avoid taxes). I was provided with tools, on a lease of $600- I did not get $600 worth of tools but that's what I paid for them because I had to, I was also given uniforms, a company van and was reimbursed for gas I paid for with my own money and would get compensated at the end of the week if the owner found it convenient to do so. Sometimes id have to wait a while or remind him multiple times.
I generally worked 50-60+ hours per week without overtime (1099 problems) and the agreement was that I'd get 40% of all money collected. I almost never saw that number match the money I brought in due to questionable "deductions" that I can't even verify because all pay was handled by the owner and would be issued via Zelle or Venmo without a paystub.
I was given minimal training other than how to bill people with their systems, and sent out in the field to mostly just Google how to diagnose and repair peoples appliances, and charge them for it (parts/labor).
I tolerated all this because I needed to have a job, since I just got here but after 3 months of ridiculous routing- limited compensation and threats of losing that job, and/or having pay reduced for various issues on the owners opinion, I was given the choice of basically take it or leave it on Friday. I snapped and finally chose to leave it.
The grand finale to this shit show is that the owner- is now refusing to pay me at all. Saying that he was gonna withhold my paycheck last paycheck for 2 weeks, because "I'm a businessman, and I run a business".
I objected to this and cited Texas law when an employee quits- or gets fired and instead he has responded with threats of not paying me at all- and instead reducing the pay to nothing and sending me an invoice for what HE determines I owe HIM.
This completely destroys me financially. My rent/car payment are due on the first (tomorrow) and I was supposed to be paid yesterday. I tried explaining that to him, and his indifferent attitude is that it sucks to be me, more or less.
ive begun the process of filing ss-8 with the IRS for misclassification of employment and have reached out to TWC but those processes take months and will likely never see me paid for any of this- if at all
This company
has stolen my last check, refused to pay me, and is now threatening me to charge me/reduce it to zero.
I've screenshotted our text conversations about it, and the last two weeks of jobs I went to but all these agencies are slow acting.
I'm fucked because of this but I hope maybe when the IRS catches wind maybe they can return the favor to these unethical and morally wrong practices.
TLDR: The appliance family are stealing my last paycheck and probably putting me out on the streets.
What else should I do beyond contacting these agencies?
I'm seeking quick, help as my time table is very short.
