my mom plans to sell our car, do i have rights over it?

for context, it was my dad’s car. it’s our family car. nakapangalan sa dad ko yung car. unfortunately he died a year ago so he left the car samin and ako na nagmamaintain and gumamit ng car since ako lang naman marunong mag drive.

me and my mom got into an argument this morning. and i heard her ranting to her sister at dinner. and i heard her say she has plans to sell the car. which is ako yung gumagamit and nag mamaintain.

if she does sell it may rights ba kami ng kapatid ko? since hindi rin naman sakanya nakapangalan car, sa papa ko pa. and hindi rin naman siya yung gumagastos sa sasakyan namin kundi ako. my brother is also a minor pa.

Is the Supreme Court correct to assume that buyers can differentiate between Lee and Stylistic Mr. Lee?

Land Title is still under my dead aunt’s name

Bali yung lola ko po yung may ari ng bahay at sa kanya nakapangalan, nung 2016 po nilipat ng lola ko ang land title sa name po ng tita ko since kinailangan sa loan po pero may kasulatan po na ibabalik ang name sa pangalan ng lola ko pag nabayaran ang loan. Nabayaran na po ang loan nung 2016 at namatay din po yung tita ko. Paano po mababalik yung Land title sa name ng lola ko?

Ang tita ko po ay may asawa and married po sila. And may kasulatan po sila na ibabalik yung name kay lola pero namatay na siya bago mabalik. And addict po yung asawa niya so we are scared di siya sumunod sa kasunduan and ibenta niya ang house ni lola :(

Foster Care or Kasambahay?

I’m looking for advice on Philippine labor/child-labor law.

A girl was taken into a couple’s household at around 16 years old because of her abusive father and stayed there until adulthood. She was sent to school and provided food and lodging, but she was also required to perform regular household work.

  • She had a timetable of household chores, starting around 5:00 AM.
  • She was directly instructed what chores to perform and was expected to be available for household duties.
  • A doorbell was used to call her from upstairs, and she was expected to immediately respond.
  • She was required to open the gate whenever the employers came home or left, including occasions around 12 midnight–6 AM. The wife is a doctor/OB-GYN, and because of her late-night and early-morning clinic duties, this occurred regularly. She was expected to respond even when she was already asleep.
  • She sometimes had to wake up from sleep to perform the gate duty.
  • She attended school during the day, then returned home around 5–6 PM and continued being available for household duties.
  • Housemaids came and went over the years. Different housemaids were employed at different times, with several leaving because they found the workload and instructions from the couple excessive. There were also consecutive periods when no other housemaid was employed, leaving the girl alone to perform the household chores in their three-storey house. When other housemaids were present, she was expected to perform duties alongside them and was treated as a worker like them.
  • During the holiday season, the couple would sometimes be away for weeks, leaving her alone in the three-storey household during Christmas and New Year. Despite living with them and being provided for, she was not treated as a member of the family, but rather as a household worker.
  • There was no written employment contract.
  • There were reportedly no SSS, PhilHealth or Pag-IBIG contributions.
  • The couple also owns/operates a maternity clinic.
  • While she was still under 18 and up to present, she was instructed to work at the clinic, including cleaning after childbirth, handling blood/bodily fluids, assisting around childbirth, receiving patients, cleaning the clinic after clinic hours and handling medical instruments.
  • She reportedly had no formal training for these duties.
  • She was sometimes instructed to sleep at the maternity clinic and remain there to wait for patients who were expected to give birth.
  • There are screenshots of clinic staff instructing her to report/assist and CCTV footage showing her working.
  • There was apparently no formal DSWD foster-care placement, Foster Placement Authority, or known licensed foster-parent arrangement.
  • She received no wages or payment for her work. She was only occasionally given a mere allowance, depending on when the couple felt like giving her money, but this was not a regular salary or payment for her work.

Questions:

  1. Can anyone advise whether the following situation involves labor or child-labor violations?
  2. Also, if violations are established, can the worker claim compensation for unpaid wages, benefits, damages, or other amounts?

Help about a case under RA 9147

Hello everyone. I want ask for things to watch out for during this turbulent times in my family.

Situation: A family member got caught in a police operation selling African Lovebirds without permit. According to the police handling the case, he was penalized under RA 9147, Section 27, Paragraph (d) and (e). In their defense, they did not know that they need a permit to sell because they’ve been selling on and off since the start of 2021.

My relative is very compliant with the police about the information/evidence needed for the case to proceed. This is a first for our family so we are simply following with the instructions told by the police.

Timeline of event for everyone’s information:
September 1, 2026
05:27 PM - Detained at the Police Station
07:30 PM - Medical Examination

The case is still on going and I want to ask what are the things we need to watch out for? or any general legal information that you can share so that I can help ease the worries of my family members. Information like how long should they be detained in the station if there will be no resolution after 24 hrs, etc. Any information about this case will help.

Old employer wont issue CoE

Hello. Ask ko lang po if may mga ganito talaga? Employed po ako sa kanila for 3yrs. Kailangan ko po kasi ng bagong coe to update my docus. Nag bigay ako sa kanila ng sss records ko kasi humingi sila as proof. 2013-2016 ako employed sa kanila and wala na daw ako record sa kanila. May scanned xerox copy ako pero wala ako hard copy. Now iniisip ko if un gagamitin ko baka mag background check tapos tawagan sila sabihin nila hindi nila ako naging employee. Matagal na nga dn naman ako nag work sknla pero concern ko is pwede ba talaga ung ganito? Eto po reply nilang email sakin:

After reviewing the document you provided, we regret to inform you that the company is unable to issue an updated COE certifying or modifying the employment details reflected in the 2016 document.

The document you provided is a copy of the COE previously issued in 2016. However, the company no longer has sufficient supporting employment records from that period to independently verify the details for issuing a new certification. In addition, the individuals who signed the original COE are no longer affiliated with the company.

As the requested certification pertains to employment from 2016, our current HR Management can only certify information that is supported by the company's records currently available and verifiable. We therefore cannot issue a new COE containing information that cannot be independently substantiated from the company's existing records.

We understand that the document is being requested for immigration purposes. However, the company must ensure that any employment certification it issues is supported by verifiable company records.

Handshake agreement with tenant family but now found out it was being subleased and no family member is now occupying the house, is it grounds for eviction?

Is it ground for eviction if found that it was being subleased to people outside the family the agreement originally made. There is no contract, only verbal agreement. Rent is 13,500 paid through e-wallet and is acknowledged through message.

Now, these sub lessees are demanding receipts but no registrations are made for the residential lease because it is only informally leased.

What to do?

Camera rentangay scammed 12+ victims total of 600,00+ pesos

Hello! We know rental is a risky business and after a year of operation this is the first time we got scammed. Yes, we do ask personal info, the scammer provided 2 id, 2 proof of address, contact etc that is needed. Since nakaprovide siya lahat ng kailangan hinand over na namin yung camera and then nung return day na she asked to extend, but i said until this day lang pwede since may next renter na. The camera was brought to baguio it has a tracker and it was tampered after couple of day, when i was asking her to return she kept saying pauwi na pero wala naman, then admitted na pinahiram niya raw sa pinsan niya na nagbolinao.

on the 4th day na niya akong niloloko repeating the same reason, nagreklamo na ako sa brgy but they cant find the address but i doubt na hinanap nila kasi mukha silang tinatamad jusko(hindi kasi ako pinasama maghanap). Next day, minessage ko na mga co owner ko(12+ victims current count) at halos lahat ng nagpaparenta dito sa amin ay narentangay same din ng modus puro extend at ayaw isoli ang camera, bumalik kami sa baranggay at sumama kami maghanap pero parent na lang ang nandoon at sinabing matagal ng di umuuwi nagreport kami sa police pero grabe napakaunprofessional kami na yung naagrabyado kami pa yung minamaliit at ang dami pang sinasabi na para bang dinidiscourage kami na ituloy ang kaso.

Kinabukasan doon pa nagsilabasan yung ibang owner na naiscam, active pa ang tracker ng isang camera at sinubukan namin magpasama sa pulis para puntahan ang suspect pero ayaw nila kami samahan ang sabi ay magreport muna daw pero nagreport na nga kami ang ending kami mismo ang nanghabol sa suspect at dinala sa police station.

Umamin na ang suspect na binenta niya ang camera pero sabi ng mga pulis na hindi raw pwedeng ikulong dahil hindi naman daw theft, since renta nga daw consented daw ang pagbigay ng cam, wala kaming magawa pumunta kami ng law office at gumawa ng final demand letter kung saan kapag hindi kami nabayaran doon pa lang aandar ang kaso, ng kinagabihan ang daming dumating na mga nagrereklamo ulit, dinala nanaman sa pulis yung suspect at walang nangyare sa total umabot na ng 600,000+ ang lahat ng camera na natangay niya pero hindi pa rin daw ito theft kahit umamin siya na binenta niya. pinadadaan pa rin kami sa due process.

Any advice to help us get any justice kasi mukhang nawawalan na kami ng pagasa or to expedite the process?

Possibly discarded pets

Hi,

There are currently 2 cats that are booked in a pet hotel since February, and, on April, when I've seen that bill has been left unpaid and haven't been visited since they were booked, I jokingly told the staff that I'd be willing to take them in and cover the bill especially after knowing the owners were students and out of the city for a vacation. I've brought this up every time I'd visit to have my pets groomed, secretly hoping they'd agree as I felt like these cats were discarded.

After a while, I've stopped visiting their store as I had become extremely busy, and sometimes out of the country, so I had my parents bring them there instead and had not asked whether the cats were still there.

Just yesterday, which is already 6 months after, I've found out that they are still in the pet hotel and that the other cat got confined (didn't ask what for) and that the bill ballooned to north of ₱50,000.

I wanted to ask whether there are legalities on perhaps why the staff or owner have not agreed to my offer, and, if yes, what are loopholes that would allow me to cover the bill and take ownership of the cats. I'm assuming the best path is to identify the owners and have them agree? Personally I don't want to resort to this.

Paid ₱1,000 for a promised product, still haven't received it after over a year. What can we do?

Hi! Looking for advice, particularly from people familiar with Philippine consumer law.

We were part of a class/program of around 40 students, where a certain product was offered separately for ₱1,000 each. We all paid for it, but it's now been over a year and the promised product still hasn't been delivered.

That's around ₱40,000 collected in total.

We've already asked for a refund, but they're not responding to our requests.

We have proof of payment and messages/materials showing that the product was promised.

What can we do at this point? Can we file a complaint with DTI? Would it be worth sending a formal demand letter first?

Would appreciate advice from anyone who's dealt with something similar in the Philippines. Thanks!

Dispute over a fence that allegedly went over the neighbour’s property line.

We bought a farm lot back in May of this year, we saw the original title and met with the seller at our representative office (one that we hired).
We finished paying the lot in full this July and yung abogado namin is now in the process of transferring the title to our name. With one issue.

I was told na “Ma'am I was informed po of the issue sa bakod. Ill be meeting the adjoining lot owner soon po. Kasi parang may Mali sa area na nabakuran”

Until now, we’re still in the process of transferring the title to our names. But due to typhoon, I heard na laging close ang office nila sa city hall.

Sabi po ng representative namin na she did let the seller and their representatives know that they needed to get the land surveyed again, even though they already had it surveyed nung binili nila ung property, just within 10 years ago.

I’m overseas and it’s really hard to manage this issue being this far. Ano po kaya ang possible solution sa issue na to? We’re also planning on building a house on that lot some time next year, but because of this dispute, we can’t really plan anything until this gets resolved.

Filing a case against anonymous reddit user

My brother was doxxed on their university subreddit. His full name and details were disclosed claiming he had cheated on a test and nagpapakalat daw ng sagot. The post even said he was spreading STDs pa. My brother is closeted (ang alam ko nga sa akin lang sya out and hindi sa parents namin, no one else) so I cant even begin to fathom why yun nasabi huhu. He’s in the top of his batch, and I know him talaga na pala-aral. Anyway, he’s been receiving anonymous dms din calling him a fake and a cheat and dapat daw iremove sa scholars. Problem is, the user who posted that has deleted their post and their reddit account but the post was live long enough for it to circulate sa batch and mapagchismisan. My brother is very sad and disappointed and we want to take legal action, but we were told since mahirap kasi reddit is an anonymous platform. What are the steps we can take kaya moving forward?

My house got robbed and the police won't do anything about it

Someone broke in my house a couple days ago and took my new phone(didn't even have it for 2 weeks) and 200k worth of jewelry. I went to the police and the front desk officer just told me to "get a dog next time" it was irritating but understandable because there was no security footage of who broke in.

A couple days have passed since the robbery, I got a notification from my email, it's an e-receipt from a delivery app from my account that someone I don't know was using, with their name, address and number but in my account. Knowing this I thought it was a good lead to catch who robbed us, so I went back to the police station to tell them that I got a lead on who the robbers might be. They remembered me and asked if I got footage of evidence on who the robbers might be and I showed them the e-receipt and told them that someone other than me is using my account.

The same front desk officer called the number of the guy using my account after I said not to because if he is the robber, a call from the police will tip them off and might go into hiding, after ignoring what I said the front desk called him anyway and the guy asked "who is this?", the officer replied "are you a delivery guy?" And the guy ended the call. The look and attitude on those cops tells me they are not interested and kept trying to dismiss me by saying " di natin alam kung Sila talaga nag nakaw sainyo baka binili lang nila Yun sa magnanakaw " and "Wala Tayo pwede magawa Kasi Wala Naman Silang ginawang mali gamit account mo eh, mag palit ka nalang ng password", even if they might be just innocent buyers who bought from the thief isn't that Worth investigating???? Ask them who they got it from. And why do I have to wait for them to do something bad with my account to report it to them? Isn't using someone else's account a crime??? I told them if they can at least pass me to cyber crime since someone is using my account, they said they can't cause even if they did they don't have legal grounds to arrest or even investigate cause there's no evidence or CCTV footage.

Insurance Claims problems

Hi LawPH,

Context first, Me and my partner were involved in a vehicular accident where only we have insurance while the one at fault doesn’t. Now we are currently insured (due to lock-in) with People’s General Insurance and we bought our vehicle in Honda Marcos Highway so we decided to claim the repairs there. LOA Was given, albeit unsatisfactory, The problem is the following:
1. Honda Marcos Highway doesn’t guarantee the quality of their ironsmith’s work, so we demanded to have the part in question be replaced
2. People’s General Insurance are very irresponsive and quite frankly, not helpful wherein they won’t do follow-ups and such until we do action first

It’s already been more than 2 months since the vehicular accident and the repairs still haven’t commenced + we can’t use the car until repairs. Our problem is the renewal is on October + registration should be done before that.

What we tried: Asked Insurance Commission for their intervention, they said that they just facilitate between parties and just aim for amicable settlements. If we want to sue People’s General Insurance for their incompetence, we need to file in small claims court. We don’t have the time and money for that sadly.

What would you do if you were in our shoes?

Previous employer withholding my COE until I sign an NDA — Is this acceptable?

Hi! Is it acceptable for my previous employer to withhold my COE or certificate of employment bc she wanted me to sign an NDA first? It has been almost a year since I requested my COE. They wanted me to sign this NDA, but I didn’t want to bc some parts were too ambiguous.

I also know about Labor Advisory No. 06, Series of 2020, stating that a COE must be released within three days after the employee asks for it. I am thinking of declining to sign the NDA and citing the advisory next time.

For context, I worked as a researcher for a project. There was also a short NDA clause written on my contract.

I have a legal age brother. Meron siyang partner for 5 years and meron silang 3 years old na daughter. Just recently nahuli niya na nag cheat yung mother ng bata, nakikipag kita sa lalaki sa inn at nagpa-plan ng mga pag bubuntis, and pagsasama kasama yung bata. Now after i-confront nung brother ko, mas galit pa siya. Nagdecide sila na maghiwalay na. Pero yung bata gusto ng mother nasa kanya which is naiintndihan namin sa Ph law tender age yun so automatic saknya. Yun ang lagi niyang panakot sa brother ko na hindi nya na makikita anak nya. My brother was a great father kasi kasama namin sila sa bahay. Yung partner niya minahal at tinanggap din namin kasi mabait naman talaga din sya. Smula nagbuntis hanggang manganak kami ang nag aruga sakanila. My brother never neglect them both. Hindi kasi safe doon sa family ng mother yung mag-ina kasi may issue ng gambling and drinking addiction yung parents nung mother.. anyways, Never namin na-imagine na she would do something like that. Gusto ng brother ko na present siya sa buhay ng anak nya. Ang gusto kasi ng mother is magsustento lang siya. Which is okay lang sana, p

Hi everyone, hingi lang po ako ng payo kung ano ang magandang gawin sa situation namin ngayon.
Nangyari po ito kanina sa puppy ko. Dinala namin siya sa grooming salon na hyper, healthy, at walang anumang baling tiil (na-confirm rin po mismo ng owner sa text na okay at masigla ang puppy nung in-abot namin sa kanila).
Pero nung pinetch na namin, biglang hindi na makalakad ang puppy ko. Dinala agad namin sa vet at batay sa X-ray, may severe fracture siya (tibial tuberosity avulsion fracture) at kailangan ng emergency surgery para maayos ang tiil niya.
Nung kinausap namin ang owner ng grooming shop:
Inamin niya na possible daw na sa loob ng premises nila nangyari ang aksidente habang nagi-blower/groom.
Pero ayaw niyang mag-commit na babayaran ang hospital at surgery bills. Sinabihan pa kami kung "pumirma ba kayo ng waiver?" na tila ginagamit niyang dahilan para takasan ang liability.
Sinabi rin niyang "magtatanong-tanong" pa raw siya sa mga kaila niya bago magdesisyon.
Ang worry ko po, kailangan na ma-opera ang puppy ko ASAP para hindi ma-permanent limp o ma-deform ang tiil niya habang lumalaki siya.
May nakaranas na po ba ng ganito sa inyo?
1. May habol po ba kami legally kahit sabihin nilang may na-sign na waiver? (Nabalitaan ko po kasi na hindi pwedeng gamiting excuse ang waiver kung dahil sa kapabayaan/negligence nila).
2. Pano po ang tamang process sa pag-file ng reklamo sa DTI o Small Claims Court para ma-reimburse ang vet bills?
3. Ano pa pong mga steps ang dapat kong gawin habang nire-review namin ang CCTV nila?
Salamat po nang marami sa mga makakapag-bigay ng payo o tulong. Gusto ko lang po maipaglaban ang puppy ko at masingil ang nararapat para sa operasyon niya.

My two fingers got amputated, what are the benefits I should demand from Employer?

I had an accident during work hours that needs my two fingers to be amputated. For anyone who's knowledgable about benefits, should I demand continous regular salary from my employer while I'm on my recovery period on top of the benefits I can get from SSS?

Good thing they cover the medical expenses and process my
SSS [as they should], however aside from the medical expenses I'm confuse if I should demand more because this happened during work hours and it's hard for me that my two fingers are gone permanately :(((

Kasi I'm just confuse kung asan ang accountability ng company sa accident na nangyari kung Philhealth [yeah sila nag bayad dahil public hospital] at SSS ang lumalabas na nag cover ng damage?

In addition, yung company namin maliit lang. And they said na SSS ang mag babayad ng leaves ko so I’m confuse.

Mom's FB got hacked, her and family's bank info are in her Messenger

The day before yesterday nag send yung account ng Mama ko ng scammy Mr.Beast pics sa lahat ng GC at contacts niya, same with my sister's messenger, and both of them were shocked because they didn't do anything. After that hindi na niya ma access yung FB niya, na change na yung email at password.

Aside from it being her personal amd work account, nandun lahat sa Messenger niya yung mga details ng kanyang bank account, gcash, etc. pati na rin sa ibang family namin (nag ssend siya nang screenshot as proof of transaction).
