"Why should prostitution be illegal. Selling is legal. Fucking is legal. Why isn't selling fucking legal? You know, why should it be illegal to sell something that's perfectly legal to give away." -George Carlin
56
u/EldritchElemental 7h ago
I used to like this statement but now the problem is that some places employes what's called the Nordic model where the selling part is now legal but the buying part isn't.
And in some places, selling your own service is legal but selling someone else's (pimping) isn't.
19
u/PierreTheTRex 3h ago
the nordic model is the other way around. Selling is legal but buying is illegal. It also criminalises people who participate in the system like hotels and pimps.
It's meant to be a way to criminalise the activity but helping the sex worker as it isn't illegal for them so they don't face any consequences if there's a bust since we consider them to be more vulnerable. The issue is this forces them into less safe environments as clients can dictate more as they are taking the risk and also makes it harder to get access to safe spaces as landlords are heavily criminalised.
From people that have studied this there's a pretty broad consensus that the best way to help sex workers is to fully legalise it and make it completely above board so that the contracts they have with the different people that provide services can be disputed in court and so they can also be in places that provide more security

u/Inevitable_You7793 10h ago
The explanation is that woman get kidnapped and get trafficked to be prostitutes. They try to go against this. It's a shale this happens a lot.
175
u/Zealous_moron 10h ago
Legalizing the act, registering the sex worker and having them work out of clean secure brothels would cut down on most sex based crimes.
10
u/Inevitable_You7793 9h ago
It cuts down sex based crimes but it doesn't cut on human trafficking crimes. Legalizing prostitution makes human trafficking a lucrative buisness.
78
u/FeeRemarkable886 8h ago
Crimilizing it only makes it harder for victims to come forward. No punishment ever stopped crime, drugs are illegal and because of that nobody uses drugs anymore, right?
20
7
u/TheyHavePinball 6h ago
Indeed. The creation of black markets is where bad actors thrive and the negatives for society are amplified.
2
u/PierreTheTRex 3h ago
How about criminalising and also making it harder for undocumented immigrants to interact with any official system without fear of retribution? Surely that helps all the trafficked workers to come out, no?
8
u/arcspectre17 7h ago
Its already a lucrative business on the black market where they 10x more just like the drug trade. They just found 137 kids in flordia!
The war on drugs didn't stop people from getting drugs now did it?
6
u/DavidJDalton 7h ago
Literally stopped it in Australia, and in the rare circumstances it does happen the police can act.

Some woman are offering the girlfriend experience. You pay for the date or to hang out, the sex is consensual. Not sure how the law deals with that. They advertise openly.
1
u/scott__p 7h ago
Yes but it's the illegal status of prostitution that leads to the trafficking. Things are are illegal can't be regulated
17

5
u/Olin_123 9h ago
Not to nearly the same extent since selling an organ is pretty permanent meanwhile all animals are built for sex.

u/L-Guy_21 8h ago
But you can sell your own organs, can you not? The issue is when you start selling other people's organs

This is because the government doesn’t like when they can’t tax things which cannot be proved to occur. The recording part is evidence hence making it taxable.
72
u/horoyokai 13h ago
thats not why though, they could tax prostitution if they wanted
43
u/sixouvie 12h ago
That's what we do in France. It's illegal to be a client but not to provide the service, so prostitutes still have to declare their income.
7
u/ThatsNotGumbo 11h ago
In the US you can pay taxes on illegal financial gains and it can’t be used as evidence against you. That’s how we handle that.
18
u/horoyokai 11h ago
Yeah so it’s hard to say something is legal if it’s illegal to use it
(I’m for full legalization personally)
14
u/Gouvernour 11h ago
We have the same in Sweden, the reason for why it is illegal to buy but not sell is to protect the seller as they more often than not are forced into the position of selling their body which can easily be manipulated by a wealthy buyer.
The illegality to buy is therefore a safety net for the prostitute to be respected and not taken advantage of, and if a prostitute would sue the buyer without them having done anything more wrong than just paying for their service it is a bad business choice on the prostitutes side as it only makes people less willing to buy their service.
It would be nice if it were fully legal on both sides but due to how bad people can be (not everyone) having a form of protection can be the better choice

Prostitution is legal if declared to the government, Pimping is not.
1
u/Lonsdale1086 10h ago
Not in the US is isn't?
It's strictly illegal to sell sex in the US other than in licensed Nevada brothels, and in Maine, where it's legal to sell but not buy.
1
u/Standard_List2328 12h ago
Not, if gets paid in cash. You can fake income.

I can understand the reservations people have, but just like with drugs all making it illegal does is force people to operate in secret, which makes the whole thing less safe for all parties involved. For that reason it should be legal and regulated.
Its one of those things thats not going anywhere so its better just to create an environment where it can be done safely
3
u/Dartz_Reverse 12h ago
The government doesnt want to help people and especially not help them get out of poverty.
Also poor druggies are easy to fault and bully, so even though many politicians, business men and rich people of all kind do drugs, its still in their best interest to keep it illegal since their wealth lets them ignore the law anyway.
Government policy has nothing to do with what "makes sense" and is entirely based around "what lets them keep power", the reason why Reagans admin criminalized drugs is no secret to anybody looking into the topic for a couple minutes, but politicians dont care because they just want to herd the population.
Corrupt child rapists and war criminals are our moral beacons.
2
u/oatkeepr 9h ago
Many women working in prostitution don't do it voluntarily, but are victims of human trafficking.
6
u/Vegetable_Bad_3187 15h ago
It's usually better for it to be illegal but be decriminalised. It's a whole mess that effects current sexual consent laws and legal definitions. In every implementation, It being legalised for some reason increases trafficking and criminals to abuse it, it legitimately allows criminals to have some modicum of legal protection to hide behind it.
I could be wrong since I don't care about them, but I think a part of the Andrew Tate human trafficking defence is a whole debate with consent and prostitution being legal where they did it? I'm not updated on it.
Should depend on country, culture, and trials of what works or not.
4
u/Sans-valeur 14h ago
I guess geography would play a big part in this but in my country I don’t believe that is the case, so far as I know.

In Sweden it's a middle ground where it's not legal to be pimping or to pay for sex but completely to legal to sell it. Emphasising the prostitutes as victims rather than perps

3
u/No-Medium6647 13h ago
There's a delicately subtly nuanced difference...
Courts have long recognized that money may be used as form of coercion. Bribery, for example.
When everyone's being coerced with money at the same time for the same purpose, that's just called "employment".
3
u/Logical_Flounder6455 12h ago
Pay her for her time, the sex is an added bonus. Thats how prostitute websites get around the laws in the UK
3
3
u/Trickstertrick 4h ago
In my country, prostitution is kind of in a legal gray area. It’s neither explicitly legal nor illegal because it isn’t regulated, and whatever isn’t expressly prohibited is generally allowed. What is prohibited is pimping or making money off someone else’s prostitution.

u/KendrickXY 13h ago
It makes sense, because it's sex vs a performance of sexual nature. It's like fighting in a bar vs pro wrestling or boxing. When you fight in a bar, you are hurting a person. When you are boxing, you are puting up a show together with your opponent. It is conceptually a different thing, even if it includes the same moves.

Men (owners + operators of porn market) make money from porn, women (sex workers) make money from prostitution.

In Denmark it's legal to make money from Sex except if you're being pimped out, then it's illegal, but if all the money goes to yourself then it's completely legal
1
1
u/tigolex 5h ago
well typically (at least prior to OF etc), porn wasn't you paying for sex it was you paying 2 other people to have sex. The two people having sex didn't exchange money with each other, they got paid by a 3rd party. Prostitution is an exchange of money for sex. So not the same thing.
In the OF era? Probably still holds true, basically, as long as the performers aren't paying each other.

u/Stooper_Dave 5h ago
Hmm, when you put it that way, I should buy a black leather couch and a production camera.
1
u/Richard_Chase 2h ago
The issues with prosecution mostly surround the exploitation of the prostitutes in question. It is far easier to regulate a film shoot as opposed to a transaction between 2 people in a hotel room. Some countries get around this by legalizing brothels that can be regulated, others ban the industry entirely

u/Somebodsydog 2h ago

I'm not sure how it works in the US, but in most of Europe prostition is legal. You just need to be registered with the appropriate paperwork. It's only illegal if you do it without a license.
Also, the reason porn is treated differently from prostitution is that porn stars are technically actors/actresses. It's impossible to make porn illegal, in practice, without also banning sex-scenes from regular movies.
1
u/L-Guy_21 8h ago
As far as I know, there is no kind of prostitution license here in the US, so it's just illegal.
