What? Haven't they ruled entirely fictional drawings can be CP but images generated from photos of real children aren't?

The First Amendment protects an individual’s right to privately possess images or videos of child sexual abuse created using artificial intelligence — if the material does not depict a real person and remains in the home, a federal appeals court judge ruled Tuesday.

As long as it doesn't depict a real child, it's all good to have AI CSAM apparently. Shit, even if it is based on a real child, how would that be enforced? So in reality it's pretty much open season for CSAM for these freaks.

Not in the US. Other countries have, but in the US only "real" pictures are illegal because children being harmed is ipso facto for CSAM to exist.

But the "AI isn't real" argument then begs the question. If somebody took a real photo, and then very accurately traced over it by hand, does that new hand drawing still get First Amendment protections?
