ding ding ding you get a gold star!!! i will say that headline is a bit misleading though, he’s not just expressing concern over a future problem, he’s actively protecting a guy who was found with a great deal of ai generated Bad Stuff on his hard drive. also it ignores the fact that It is being trained off Bad Stuff. anyways this is not really the time or place to properly discuss these complex topics and the real context is i wanted to use that gif

And all the dumbasses that say "it's not confirmed it's actually trained on CSAM" are dumb AF, it's literally how it works, if you don't train your AI on a simple tree for example, you will never be able to generate a tree as it doesn't know what a tree is or what it looks like, same with AI generated CSAM.

Now you could if you stretch it say that it's trained on just images of children and the sexual side were adults, but I would assume too many artifacts would be showing up.

That's not the supreme Court making it legal, it's an appeals court saying "this is technically legal per our current laws, and it really shouldn't be, but it is out of my hands to fix"

This is a bit more complicated than just that description. It could easily be used to censor vast swathes of the internet in the current implementation.

I would support one that was purely focused on making AI CSAM illegal.

i mean yes, please don't form actual political opinions based on an r/whenthe post i made in like fifteen minutes. it's a very weird and complicated topic, so i appreciate you adding more context.

I will however say that the problem with ai generation specifically is that the judge acknowledges that generating images based on real children is illegal. However, I frankly don't see much difference between that specific implementation of Bad Stuff and generating images based on an ai trained on Bad Stuff.

The ruling would just as easily target normal pornography (not even AI generated), or stuff like sex education, queer spaces, etc.

The Internet is so compacted into a few corporate sites who are very wary of getting sued, so they have historically sought to remove all adult content rather than moderate their platforms.

Yeah that is absolutely revolting. To make AI generated CSAM you have to first use images containing actual children, all of these LLMs have trained on images of kids. While the child depicted in Pervert Pedo's AI generated CSAM may not actually exist, the resources used to generate it used real people

And SCOTUS the courts say as long as you keep it in your house it's A-OK

the judge in question gets a bit of credit because of how clearly uncomfortable he is with the ruling, but it’s still a clusterfuck and the court system still fucking sucks.

also, i got the names mixed up and it’s not the supreme court, just regular federal court for now.

They didn't make it legal. They ruled that with their current laws it counts as legal because it is fantasy porn, just like drawn loli/shota

They realize how fucked this is and will work on the legality and ethics of it
It's an interesting ethical question tbh. If it's realistic but nobody was harmed, should it he legal?
Obviously it was trained on real cp so technically kids were harmed, but it's using something that already exists specifically to make more stuff without victims

IMO it should be illegal but I can not give a better reason than "it feels wrong and disgusting" personally

i mean yeah "hey i wonder what a federal appeals court just established a precedent of legality for" doesn't exactly roll off the tongue, i kinda hoped people do their own research and make their own judgements but maybe that was too optimistic 💀 anyways thanks for clearing stuff up, it's nice to have some actual nuanced opinions in this hellhole of website

anyways, my personal take on the legality of it is that ai generated CSAM has to be trained off actual CSAM, thereby making it closer to an ai edited image of an existing child, in my opinon (which is Very illegal). it also could hypothetically make it easier to distribute (what if you slip in some real pictures?). the case involved also has an extra layer of problems, because the guy being charged was accused of distributing to minors, not just possessing. It's a bit like the case of that gun you could 3D print, except if the only way to make a 3D printable file was to do a school shooting. it's just not enough layers removed from the real deal to be excusable. but anyways i am also pretty strongly biased against CSAM, believe it or not, so I admit to being pretty heavily biased.

Otherwise actual distributions could claim it was AI. It is possible to prove something is AI, but impossible to prove something isn't AI

It's disgusting but it was NOT the Supreme Court that ruled this, it was a district Court, the Judge also went on to state that the laws need to be updated to make this illegal as there are currently no federal laws that pertains to ai regulations (good luck getting that done with these demons in charge)
