Need advice on selling a 2nd-hand car with an encumbrance on the CR
Hello everyone! I’m hoping someone here has knowledge about the documents and process involved in selling a 2nd-hand car, especially one with an encumbrance indicated on the CR.
For some context, my parents bought me a 2nd-hand car during my first year of college. We paid the down payment and everything else without thoroughly checking the documents. Only my mom was able to come with me because both of my parents are OFWs, and at the time, she wasn’t aware of any potential issues with the car’s paperwork.
I recently learned that having an encumbrance on the CR means there is still a financial/legal claim over the vehicle, usually from the bank or financing company.
My questions are:
- How can I legally sell this 2nd-hand car?
- What is the process for selling a car that still has an encumbrance on the CR?
- Do I need to have the encumbrance removed first before I can sell it?
- I also haven’t transferred the registration/title to my name yet. Is it possible to sell it to a third owner by simply having another Deed of Sale executed?
I’m planning to sell the car because I’ll be migrating after college, and I’ll be handling everything on my own.
I’d really appreciate any advice from people who have dealt with a similar situation, especially regarding the proper documents and process. I want to make sure I do everything legally and properly.
