In today's media environment and the lack of centralized local socializing, this is going to happen. People get into their echo chambers, no one pushes back, and people come out of the echo chamber with extreme views.

Its important to note this happens with men and white people too. Peoples view of events are colored by their identity and need to belong to a group. No human is exempt from having their worst biases reinforced by an echo chamber. You are on reddit after all.

This is about Lindsay Clancy. She is a woman who strangled her 3 children to death and tried to commit suicide (but failed) afterwards. Her husband was not home at the time.

Sean Strickland is implying with his tweet that this should be an easy and simple decision for the jury. Since the jury is still deliberating and appears to be in deadlock, the females on the jury (according to Sean) must be extremely biased. Obviously, nobody outside the jury knows what's going on behind deliberation room doors. They are locked and soundproofed for a reason. For all we know, the men could be siding with the defense. We don't know the thought process behind any of the jurors.

Nobody is denying the what, how, and when of this tragedy. Even her own defense and supporters agree she did it. It's whether she was legally responsible or not. The divide is whether this woman was sane enough during the event (guilty of premeditated murder) or having some sort of postpartum psychosis break (not guilty by reason of insanity).

Jurors are still deliberating and currently in a deadlock so mistrial is likely. Judge will obviously try to resolve the deadlock before declaring mistrial. Mistrials do not mean the defendant goes home free. The ball is left in the prosecution's court - they have to decide whether to retry the case w/ a new jury (double jeopardy does not apply after mistrial), offer plea bargain or drop the charges completely.

On July 30th, 2008, Vincent Li stabbed and killed Tim McClean on a Greyhound bus from Edmonton to Winnipeg in Canada. He then proceeded to decapitate Tim, display his head to people outside the bus, and cut off other portions of his body and eat them before the police showed up and arrested him.

In the trial that followed, it was determined that Vincent Li was not criminally responsible due to having undiagnosed schizophrenia (apparently people just assumed he was a very devout Christian convert when he told people that Jesus spoke to him). He was remanded to a mental institution in 2009.

By 2012 (3 years later), he was allowed to take supervised trips into the nearby town. By 2014 (5 years later) he was allowed to take unsupervised trips into the nearby town. By 2015 (6 years later) he was allowed to take unsupervised day trips to Winnipeg so long as he kept a cell phone on him at all times. By 2016 (7 years later) he was allowed to live independently outside of the prison. In 2017, 8 years after being committed, he was given a full non-conditional discharge, with no legal obligations or responsibilities above and beyond those of any other citizen.

While I am usually pretty quick to be critical of the Canadian justice system this seems reasonable. He was determined to have committed the crime as the result of a psychotic episode, doctors determined the issue was resolved, slowly reintegrated him into society and he has not committed any crimes since.

This seems better than the alternative of locking up a now healthy person for decades at the expense of the tax payer.

Prison is meant to deter and rehabilitate. If it's true that she is genuinely and severely mentally afflicted, then prison wouldn't do anything. You can't deter behavior that wasn't 100% unintentional, but you can still protect the public from her by holding her in a mental institution.

The jury is most likely debating whether she should go to prison or a high security psychiatric hospital. Basically is she guilty, or not-guilty by reason of insanity. Both are effectively a sentence of confinement for the rest of her life.

The judge made it clear to the Jury that the shortest commitment he'd seen on the bench was 8 years and the longest was committed at 19 and was still committed at 80.

Given that's she's currently in a mental health facility on a 1:1 suicide watch I'd reckon she's not going anywhere anytime soon

It’s not guaranteed permanent commitment. After you are committed you are assessed after 6 months and if you are recommitted you get reassessed every year after that.

And once you are assessed competent the criminal sentencing term can begin. It's so rare for anyone to be guilty but insane to be freed.

In reality what happens is they get committed for 6 months or a few years, and then once they are "fixed" they get moved to prison.

Its the norm here as well. The question is pretty much does she belong in an institution (she's already in one) or prison. She admitted to killing the kids but the postpartum psychosis doesnt put her in sound mind to have the knowledge component of commiting the crime. Not guilty by reason of insanity can very much still result in indefinite confinement in a mental institution.

If she gets a not guilty verdict she’ll be sent to a mental hospital. The case isn’t about if she did it or not it’s about if she wasn’t mentally sound or not when she did the murders. I think she should be found guilty.

Acquittal isnt on the table. The question is whether she is guilty, or not guilty by reason of insanity (NGRI).

An NGRI finding sends her to a mental facility until she is deemed to have been treated, no longer s threat to society, and the mental facilities discretion (essentially) that she is no longer mentally ill.

In essence, NGRI is a life sentence for which you are eligible for parole, and which is served at a mental hospital rather than a prison (theres a but more nuance to it, but thays the gist).

I cannot overstate that no one (excepting, perhaps, a handful of actual crazies on ticktock) is advocating for her aquittal or innocence; the majority "supporting" position is that she should be treated/confined to a mental hospital, rather than being sent to prison, which is consistent with decades of law (that no one cared about previously) where someone suffering from acute psychosis kills during a psychotic episode, and is found NGRI.

Again: no one is hoping for an aquittal. Additionally, to be clear, you are free to think than an NGRI finding is inappropriate based on either, or both, policy reasons (e.g., NGRI shouldnt exist) or factual reasons (e.g., you don't believe she was actually psychotic). But its imperative to understand that no one (again excepting some ticktock crazies) is saying she should be aquitted.

She deserves some empathy for what she did, but that doesn't absolve her of what she did. Some of the conspiracy shit is stupid but the prosecution saying she was of sound mind is misguided. IMO Psych ward for the rest of her life is reasonable.
